Welcome to the alBOOM! mobile application, which allows users to transfer photos and videos in high resolution to their phone's contact list. By using our app, you agree to comply with the following terms and conditions listed below. 

• App Description: The alBOOM! mobile application ("App") developed by ONovate L.L.C. FZ ("Company") allows users to upload and transfer content to their contacts, including images and videos ("Content"), which is designed to self-destruct and become unavailable on the App after 24 hours from the time of upload.
• User Account: To use our app, you will need to sign up for an account. You will be required to provide your name, email address, and phone number. By creating an account, you agree that the information you provide is accurate and complete. By using the App, you represent that you are at least 13 years old or the age of legal majority in your jurisdiction. If you are under the age of 13, you must not use the App. 
• Phone Contacts: In order to use the app effectively, you will be required to allow the alBOOM! app to access your phone contact list, which will be integrated within the app. This allows you to easily send photos and videos to your contacts. 
• Personal Information: We take your personal data privacy seriously. Your personal information, including your name, email address, and phone number, is stored securely and will not be shared with third parties, except as required by law or as necessary to provide you with our service. We may use your personal information to contact you regarding updates to our app, changes to our terms and conditions, or to provide you with promotional offers.
• User Content Ownership: You retain all ownership rights and intellectual property rights to the Content you upload on the App. By uploading Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, transmit, and distribute the Content solely for the purpose of operating and providing the App's functionalities.
• Data Security: We use industry-standard security measures to protect your personal information and prevent unauthorized access to your account. However, you acknowledge that no system can be completely secure, and we cannot guarantee that your personal information will be completely secure at all times. 
• Contact Permissions: By using our app, you give us permission to contact you via phone or email for specific purposes related to our service, including notifications, password reset requests, payment confirmations, and other communications related to your use of our app. You acknowledge that these communications are necessary to provide you with our service and that you may not opt-out of receiving them.
• Uploading Content: You understand and agree that the content you upload on the App will automatically self-destruct and become permanently unavailable on the App after 24 hours from the time of upload. The Company is not responsible for the retrieval or preservation of the Content after it has self-destructed. You will be required to re-upload the content, after the 24 hours has elapsed, which will be chargeable if your free 1GB has been utilized. You are solely responsible for any content that you upload to the app and you must ensure that you have the necessary rights to upload such content. The app and the app owner will not be held liable for any illegal, fraudulent or unauthorized content upload. You are solely responsible for complying with all applicable laws and regulations governing the uploading of data.
• Data Transfer: All users will be given 1GB of free data transfer. After using the free data transfer, you will need to buy additional transfer bytes using the Swype payment gateway. The payment gateway is a third-party service provider and your use of their service is subject to their terms and conditions. You accept that you are responsible for paying for the different packages available and will not be refunded if you do not use the full data bytes purchased in the package. 
• Prohibited Conduct: You must not use the App for any illegal, fraudulent, or unauthorized purposes. You must not upload any content that is defamatory, obscene, offensive, or infringes any third-party rights. You must comply with all applicable laws and regulations governing the uploading of data. We are not legally responsible for any user's prohibited conducted on the app. The App owner reserves the right to deactivate user access at any time, without refunding any payments made by the user, if the user fails to abide by the law and rules in the terms and conditions. 
• Data Security: We use industry-standard security measures to protect your personal information and prevent unauthorized access to your account. However, you acknowledge that no system can be completely secure, and we cannot guarantee that your personal information will be completely secure at all times.
• Intellectual Property: The App and its contents, including any logos, trademarks, and copyrights, are the property of the App's owner. You are not allowed to use any of the App's content for commercial purposes without the owner's prior written consent.
• Disclaimer: The App is provided on an "as is" and "as available" basis. We do not make any representations or warranties, whether express or implied, about the accuracy, completeness, reliability, suitability, or availability of the app. We disclaim all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the app, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses. You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your breach of this Agreement or your use of the App.
• Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the app's owner is based. 
• Amendments: We reserve the right to amend these terms and conditions at any time. It is your responsibility to refer to the App for the updated terms and conditions. Your continued use of the App after any amendments shall constitute your acceptance of the updated terms and conditions.  

By using the ALBOOM! app, you accept and agree to abide by these terms and conditions. If you disagree with any part of these terms and conditions, please uninstall and discontinue use of the app. 

We are committed to protecting your privacy and ensuring that your personal information is handled in a safe and responsible manner. This Privacy Policy outlines how we collect, use, and protect your information.

6.  Payment methods

The alBOOM! app accepts payments through Apple Pay and Google Pay, providing a secure and convenient way to complete transactions. By using these methods, you agree to their respective terms and conditions. Transactions are processed by Apple Inc. and Google LLC and for more details, please refer to the security information provided by Apple Pay and Google Pay. 

7. Third-party Links and Services

Our app may contain links to and integrate with third-party services listed below. While we strive to work with reputable third-party providers, we do not have control over the privacy practices of these external services. We encourage you to review the privacy policies of any third-party services you interact with through our app.

• SMSala: Our app uses SMSala as a SMS gateway to send notifications and verification messages to your mobile device. This SMS gateway may collect and store your phone number and message data as part of their service.
• Azure: We utilize Azure as our third-party cloud service provider to store and manage data that you share, until they are automatically deleted. These providers may have access to your personal information as part of their service provision. 
• Apple App Store and Google Play Store: Our app is available for download through the Apple App Store and Google Play Store. These platforms may collect and process data about your device, app usage, and download activity. Please review their privacy policies for more information on their data practices.
